Terms of Service

As of: 30 September 2026. These Terms apply to subscriptions concluded from the commercial launch onward. This is the English version of our AGB (German).

1. Who we are, what these Terms cover

These Terms govern the use of the desktop software MenuTome (the "App") and the Pro and Max subscriptions. The provider of the App and your contractual partner for its use is

Gesellschaft bürgerlichen Rechts Enrico Kaldasch & Pornvilai Kaldasch
(a German civil-law partnership, "GbR")
Ackerstraße 19, 04910 Elsterwerda, Germany
Email: info@menutome.de

("we"). The App is directed at both consumers and businesses; conflicting or deviating terms of the user do not apply.

Two contracts, two contracting parties — in short: For using the App and for the licence, we are your contracting party. The purchase of a subscription, however, runs through Lemon Squeezy as Merchant of Record; that is where the purchase contract is formed. What exactly this means and whom you contact for what is explained in Section 4.

2. What MenuTome is — and deliberately is not

MenuTome is a local-first desktop application for Windows: from your recipes it creates a print-ready cookbook (interior PDF and cover, e.g. for Amazon KDP, plus a digital edition). Your recipes, photos and book projects are stored exclusively locally on your computer. There is no user account, no cloud storage and no synchronisation; we do not hold a copy of your content. The App works offline after activation; only activation and the periodic subscription check briefly require an internet connection.

3. The tiers: Basic, Pro and Max

The feature description shown at the time of purchase is decisive. The tiers differ as follows:

  • Basic (free): one finished book in total, up to 15 pages per book. The digital edition carries a MenuTome mark (watermark). The Amazon print package (interior and cover with bleed) is not included.
  • Pro: one finished book per billing month, with no page limit, including the Amazon print package and a digital edition without the mark. An unused book allowance expires at the end of the billing month; it does not carry over.
  • Max: like Pro, but without a limit on the number of books — plus the additional sales tools, to the extent they are listed in the feature description on the pricing page.

In your favour, the following always applies:

  • You can create and edit recipes and book projects without limit at every tier. Only the finished export is ever counted, never the drafting.
  • A book only "counts" once it has its first finished export. Previews never count.
  • Once a book has been exported, it stays exportable — as often as you like, even after your subscription ends. Corrections, a second edition or a new cover of the same book cost you nothing. If you withdraw from your subscription, this does not apply to books you finished under that subscription. You may keep the files already created; you can then re-export them only at the Basic tier.
  • The billing month runs from the day you subscribed (not per calendar month).
  • Under Basic, a book that has already been exported still counts even if you delete it afterwards.

4. Formation of contract, contracting parties and payment processing

When you take out a paid subscription, two contracts are formed:

  • The usage and licence agreement — with us. We make the App available to you, grant the usage right under Section 6, deliver the updates under Section 9, and are your contact for warranty and support.
  • The purchase contract for the subscription — with Lemon Squeezy. The purchase is processed through Lemon Squeezy as Merchant of Record. Lemon Squeezy sells the subscription in its own name, collects the payment, issues the invoice and remits the applicable taxes. Your contracting party for purchase, payment and billing is therefore Lemon Squeezy; its full provider details and terms are displayed to you during checkout and sent with your purchase confirmation.

The purchase contract is formed when you click the order button at the end of the Lemon Squeezy checkout and the payment is accepted. After a successful purchase you receive an email confirming the contract together with a licence key, which you activate in the App under "Subscription & Licence".

When Pro or Max starts: After activation, the app asks whether we should begin right away. If you expressly request this, Pro or Max is available to you immediately; your right of withdrawal then expires as described in the withdrawal instructions. If you do not request it, we unlock Pro or Max once the withdrawal period has ended (usually from day 15 after purchase) without you having to do anything; until then you use MenuTome at the Basic tier and can switch to an immediate start in the app at any time. In both cases, the billing month starts on the day of purchase.

What this split means for you — and what it does not: Your rights against us are not reduced by this. You may declare withdrawal and cancellation either to us or to Lemon Squeezy. If you declare them to us — via "Withdraw from contract here" or "Cancel contracts here" in the footer of every page —, we confirm receipt to you without delay in text form and take care of the rest with Lemon Squeezy; the decisive moment is when your declaration reaches us. The refund in case of withdrawal is made by Lemon Squeezy, because that is where the payment was received (details on the Withdrawal page).

Number of devices: A licence key can be used simultaneously on two of your own devices (Pro) or on five of your own devices (Max). You can free up a used slot yourself — in the App under "Subscription & Licence" via "Remove from this device". If the device no longer exists, an email to info@menutome.de is enough; we will free the slot.

5. Prices

The prices shown on the pricing page and at checkout at the time of the order apply. All prices are total prices in euros and include statutory VAT. The free Basic tier remains free; it is not a time-limited trial offer.

6. Your right of use — and your rights in your books

With the subscription (or, for Basic, upon installation) you receive a simple, non-transferable right to use the App for your own purposes. Not permitted: passing on or reselling the licence key, circumventing the tier limits or the Basic mark, and reverse engineering the App beyond what the law permits.

Your content and the books you generate belong to you. We do not acquire any rights in recipes, photos or texts that you bring into the App. Books generated with MenuTome (PDF files, covers) may be used by you without restriction — including selling and publishing them, with no fees owed to us. The only exception: the MenuTome mark on the Basic edition may not be removed.

7. AI features

AI features run by default via a local AI model on your own computer. Optionally, you can enter your own API key for an external AI provider; in that case that provider's terms and prices also apply, and the content to be processed is transmitted to that provider (details in the Privacy Policy).

AI output may contain errors. Check in particular quantities, temperatures, cooking times and notes on ingredients that can trigger intolerances or allergies before you publish a book. You are responsible for the content of the books you publish.

8. Your cooperation: rights and data backup

  • You ensure that you hold the necessary rights in all content you contribute (e.g. recipe text taken from elsewhere, photos, images).
  • Because all data is stored only locally on your device, backing it up is also your responsibility. Back up the MenuTome data folder regularly — we cannot restore lost local data because we hold no copy.

9. Updates and warranty

We provide the updates for the App that are required to maintain conformity with the contract (Section 327f of the German Civil Code, BGB), and inform you in the App about available updates. The statutory warranty rules for digital products (Sections 327 et seq. BGB) apply. There is no entitlement to new features beyond the feature description; further development beyond that duty remains voluntary.

10. Term and cancellation

Subscriptions run monthly and renew for a further billing month each time until you cancel. You may cancel at any time, effective at the end of the current billing month — there is no minimum term and no notice period. The right to extraordinary termination for good cause remains unaffected.

The easiest way to cancel is the button "Cancel contracts here" in the footer of every page of this website — no login required, with immediate confirmation of receipt. Equally effective: an informal email to info@menutome.de, or cancelling your subscription directly in the Lemon Squeezy customer portal (accessible via the link in your purchase confirmation).

What happens after your cancellation: We confirm receipt of your cancellation to you without delay in text form — when cancelling via this website, immediately on screen (to save and print) and additionally by email. The cancellation takes effect at the end of the already-paid billing period: until then you can keep using your subscription in full; after that nothing more is charged and it does not renew again. We end the renewal of your subscription with Lemon Squeezy for you; you do not need to do anything additional there. You do not have to observe an advance notice period such as the one set out in Lemon Squeezy's general buyer terms (48 hours): we end the renewal immediately after receiving your cancellation. If a renewal is nevertheless charged, we will refund it to you in full. In case of an extraordinary cancellation for good cause, your subscription ends on the date you specify; we will get back to you about this the same way. If you specify a date of your choice for an ordinary cancellation, your subscription ends at the end of the billing month in which that date falls.

When the paid period ends, your licence key expires and your installation falls back to Basic. Your recipes and projects remain fully intact, and books already exported remain exportable indefinitely (Section 3) — corrections, a second edition or a new cover cost you nothing even after the subscription ends. If you withdraw from your subscription, this does not apply to books you finished under that subscription. You may keep the files already created; you can then re-export them only at the Basic tier.

11. Right of withdrawal

Consumers have a statutory right of withdrawal. The withdrawal instructions, the model withdrawal form and the online withdrawal function are on the Withdrawal page.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee we have given.

For slightly negligent breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

For loss of local data we are liable under the above rules only to the extent that the damage would also have occurred had reasonable, regular data backups been made (Section 8).

13. Open beta phase

As long as the App is marked as being in "open beta", all functions are unlocked free of charge. The beta phase is not a paid service; there is no entitlement to the continuation of the free feature scope. At the commercial launch, the tier separation under Section 3 applies — anything you have finished exporting by then remains exportable indefinitely under the rule in Section 3.

14. Changes to these Terms

We may adapt these Terms with effect for the future where there is good cause (e.g. changes in the law, new features, or changes at payment service providers) and the adjustment is reasonable for you. We will inform you of changes at least six weeks before they take effect, by email or in the App; this does not affect your right of cancellation under Section 10. Changes to the App itself that go beyond maintaining conformity with the contract are made only under the conditions of Section 327r BGB.

15. Final provisions

German law applies. If you are a consumer with your habitual residence abroad, the mandatory consumer-protection provisions of your country of residence remain unaffected. You can conclude the contract in German or in English. These Terms exist in both languages with identical content; both versions are equally binding.

We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board (Section 36 of the German Consumer Dispute Resolution Act, VSBG).
